General Terms and Conditions of Dingdong Nederland B.V.

1. Corporate Information
Dingdong Nederland B.V. is established at Van Dompselaerstraat 37, 3772AC in Barneveld, the Netherlands. Registered with the Chamber of Commerce under number 94654247. You can contact us via email: henco@dingdong-nederland.nl.
2. Services
Dingdong Nederland B.V. provides a mobile application (the “App”) through which room seekers and residents with a vacant room can locate one another. Additionally, we operate a website that serves to promote our company and to redirect users to the App Store and Google Play Store. It is not possible to search for rooms or roommates via the website.
Dingdong Nederland B.V. cannot guarantee that users will find accommodation or a roommate. Furthermore, we cannot guarantee that the found accommodation or roommate is suitable. Users are solely responsible for entering into arrangements with other users.
3. Applicability
These general terms and conditions apply to the use of the App and the website of Dingdong Nederland B.V. By utilizing our services, you consent to these terms and conditions.
4. Terms of Use
The App is available to users within and outside the Netherlands. As the objective is to find accommodation in the Netherlands, Dutch law shall govern. Legal disputes shall be settled by a court in the Netherlands to be determined at a later date.
The use of the App is free of charge. Charges shall apply for additional features and services, such as subscriptions and individual likes.
To use the App, users must be at least 16 years of age. Users under the age of 18 require explicit permission from a parent or legal guardian. Users over the age of 18 do not require such permission.
Users are required to provide correct and up-to-date information upon registration and use of the App.
5. Payments
The following subscriptions are available for Dingdong Select:
1 month: €9.99 including VAT.
2 months: €17.99 including VAT.
3 months: €19.99 including VAT.
All subscriptions are purchased through the Apple App Store or Google Play Store. In addition to these General Terms and Conditions, the terms and conditions of the respective platform also apply to the purchase, payment, renewal, and any refund requests.
The full subscription fee will be charged immediately upon purchase via the payment method linked to the user's Apple or Google account.
Subscriptions are automatically renewed at the then-current rate, unless the user cancels the subscription at least 24 hours prior to the end of the current subscription period through the settings of the Apple App Store or Google Play Store. After cancellation, the subscription remains active until the end of the already paid subscription period.
Users can manage, modify, or terminate their subscription at any time through the settings of their Apple App Store or Google Play Store account.
Payments are processed by Apple and Google. Dingdong does not process any payments itself and does not have access to the users' payment details.
If a user has previously purchased a subscription and wishes to regain access to an already valid subscription, the 'Restore Purchase' function inside the app can be used.
6. Right of Withdrawal
A Dingdong Select subscription concerns a digital service that is made available immediately upon purchase. After a successful purchase, the user immediately receives access to the Premium features of the app, which include, among other things, unlimited responses to rooms and other paid functionalities.
By purchasing a subscription via the Apple App Store or Google Play Store, the user requests immediate performance of the agreement. To the extent permitted by law, the statutory right of withdrawal thereby lapses as soon as the performance of the digital service has commenced.
For purchases made via the Apple App Store or Google Play Store, the terms and conditions and the refund policy of the respective platform additionally apply. Requests for a refund must be submitted through the respective platform. Dingdong cannot grant refunds for purchases made via Apple or Google, unless Dingdong is obliged to do so pursuant to mandatory law.
This provision does not affect mandatory consumer rights regarding defective or non-conforming digital services.
7. Use of the App
Users may only use the App for legitimate purposes.
The posting of incorrect, misleading, or inappropriate content is prohibited.
Dingdong Nederland B.V. reserves the right to block or delete accounts in the event of misuse or violation of these terms.
8. Liability
Dingdong Nederland B.V. is not responsible for agreements or arrangements concluded between users themselves.
We endeavor to provide a secure environment, but do not guarantee complete protection against undesirable behavior.
Dingdong Nederland B.V. is not liable for any damage, direct or indirect, resulting from the use of the services, unless there is intent or gross negligence.
In the event of indirect damage, such as loss of profit, data, or business opportunities, Dingdong Nederland B.V. cannot be held liable.
Dingdong Nederland B.V. does not guarantee that users will find a roommate or accommodation, nor that the found roommate or accommodation will be suitable.
9. Force Majeure
Dingdong Nederland B.V. is not liable for any damage or delay in the performance of its obligations if this is the result of force majeure.
Force majeure shall mean any situation beyond the reasonable control of Dingdong Nederland B.V., such as, but not limited to, natural disasters, war, terrorism, pandemics, disruptions in telecommunication or internet systems, or technical disruptions outside our sphere of influence.
In the event of force majeure, Dingdong Nederland B.V. shall inform the user of the delay or cancellation of the services, and shall endeavor to provide a solution as soon as the situation permits.
10. Intellectual Property
All rights to the App, website, and content belong to Dingdong Nederland B.V.
Users may not copy, distribute, or use any parts of the App or website without prior written permission.
11. Privacy
The use of the App is subject to our Privacy Policy, which describes how we handle personal data. Please consult our Privacy Policy for further information.
12. Applicable Law
These general terms and conditions are governed by Dutch law. Any disputes shall be submitted to the competent court in the Netherlands.
13. Amendments to the General Terms and Conditions
Dingdong Nederland B.V. reserves the right to amend these terms at any time. Amendments will be communicated via the App or website and shall take effect 30 days after publication.

Dingdong Nederland B.V. cannot guarantee that users will successfully find accommodation or a roommate. Furthermore, we cannot guarantee that the accommodation or roommate found will be suitable. Users are solely responsible for entering into agreements with other users.
3. Applicability
These terms and conditions apply to the use of the App and the website of Dingdong Nederland B.V. By utilizing our services, you agree to these terms.
4. User Terms
The App is available to users both within and outside the Netherlands. Since the primary objective is to find accommodation within the Netherlands, Dutch law shall apply. Legal disputes shall be adjudicated by a competent court in the Netherlands, to be determined at a later stage.
The basic use of the App is free of charge. Additional features and services, such as subscriptions and individual likes, are subject to charges.
To utilize the App, users must be at least 16 years of age. Users under the age of 18 require explicit permission from a parent or legal guardian. Users aged 18 and older do not require such permission.
Users are required to provide accurate and up-to-date information when registering and using the App.

All subscriptions are purchased through the Apple App Store or Google Play Store. In addition to these Terms and Conditions, the terms and conditions of the respective platform also apply to the purchase, payment, renewal, and any refund requests.

Subscriptions renew automatically at the applicable subscription price unless the user cancels the subscription through the Apple App Store or Google Play Store settings at least 24 hours prior to the expiration of the current subscription period. Following cancellation, the subscription will remain active until the end of the already paid subscription period.
Users may manage, modify, or cancel their subscription at any time through the settings of their Apple App Store or Google Play Store account.
Payments are processed by Apple or Google. Dingdong does not process payments directly and does not have access to the payment details of users.
If a user has previously purchased a subscription and wishes to restore access to an active subscription, they may utilize the "Restore Purchases" feature within the App.
6. Right of Withdrawal
A Dingdong Select subscription is a digital service that is made available immediately upon purchase. Upon successful purchase, the user receives immediate access to the App's premium features, including, but not limited to, unlimited responses to room listings and other paid functionalities.
By purchasing a subscription via the Apple App Store or Google Play Store, the user explicitly requests the immediate performance of the contract. To the extent permitted by applicable law, the user's statutory right of withdrawal expires once the performance of the digital service has commenced.
Purchases made via the Apple App Store or Google Play Store are also subject to the terms, conditions, and refund policies of the respective platform. Any requests for a refund must be submitted through the relevant platform. Dingdong cannot facilitate refunds for purchases made through Apple or Google unless required to do so under mandatory applicable law.
Nothing in this provision limits or excludes any mandatory consumer rights regarding defective or non-conforming digital services.
7. Use of the App
Users may only utilize the App for legitimate purposes.
The posting of incorrect, misleading, or inappropriate content is strictly prohibited.
Dingdong Nederland B.V. reserves the right to suspend or terminate accounts in the event of misuse or violation of these terms.
8. Liability
Dingdong Nederland B.V. is not responsible for agreements or arrangements concluded between users.
While we endeavor to provide a secure environment, we cannot guarantee comprehensive protection against undesirable behavior.
Dingdong Nederland B.V. shall not be liable for any direct or indirect damages resulting from the use of the services, except in cases of willful intent or gross negligence.
Dingdong Nederland B.V. shall not be liable for indirect damages, such as loss of profit, loss of data, or loss of business opportunities.
Dingdong Nederland B.V. does not guarantee that users will find a roommate or accommodation, nor that the roommate or accommodation found will be suitable.
9. Force Majeure
Dingdong Nederland B.V. is not liable for any damage or delays in the performance of its obligations due to force majeure.
Force majeure shall include any situation beyond the reasonable control of Dingdong Nederland B.V., such as, but not limited to, natural disasters, war, terrorism, pandemics, failures in telecommunications or internet networks, or technical issues beyond our control.
In the event of force majeure, Dingdong Nederland B.V. will inform the user of the delay or suspension of services and will endeavor to provide a solution once the situation permits.
10. Intellectual Property
All rights to the App, website, and content belong exclusively to Dingdong Nederland B.V.
Users are prohibited from copying, distributing, or otherwise utilizing portions of the App or website without prior written consent.
11. Privacy
The use of the App is subject to our privacy policy, which describes how we process personal data. Please consult our privacy policy for further details.
12. Applicable Law
These terms and conditions are governed by Dutch law. Any disputes shall be submitted exclusively to the competent court in the Netherlands.
